Not all Buy to Let mortgages are regulated by the Financial Services Authority (FSA). If 40% or more of the property to be mortgaged will be or is intended to be occupied as residential accommodation by you or a related person, then your mortgage will be regulated.

The Financial Services Authority (FSA) defines a Related Person as:

  • The borrower's spouse.
  • A person (whether or not of the opposite sex) whose relationship with the borrower has the characteristics of the relationship between husband and wife.

  • The borrower's parent, brother, sister, child, grandparent or grandchild.


  • Property means:
  • Space within the property and Land used in connection with the dwelling, would include house, driveway and garden.

  • The share of the aggregate floor and/or land area used directly in connection with the habitation of the property. Portions of the property used directly for business purposes would be excluded.

  • Non Connected land is where the use is unconnected or can exist without the dwelling e.g. Farmland


  • Examples of property types:
  • Converted flat means that the building used to be another type of property such as a large house which has been converted into flats. E.g. a 'Victorian conversion'.

  • A maisonette is similar to a flat, except that it is usually on two levels and has its own entrance rather than sharing an entrance with other flats in the building.

  • An agriculturally restricted house is one where the occupier must either be retired from, or obtain a percentage of their income from farming (either employed by a local farmer, or producing from their own smallholding). This type of restriction varies from area to area. Your local council can give you details if this applies to you.

  • A studio flat is a flat without a separate bedroom; i.e. the bedroom is included in the living space.
